Please read these Terms of Service ("Terms") carefully before using the services offered by FastTrack ("we", "us", "our"). By accessing wearefasttrack.com, purchasing our services, or communicating with our team, you agree to be bound by these Terms.


1. About FastTrack

2. Service Description

2.1 Initial Assessment Consultations

All services begin with a non-refundable assessment consultation:

Marketplace Appeals & UK/EU Expansion - $99 Assessment

Review your situation, product, or business requirements

Analyze feasibility and compliance requirements

Provide a detailed assessment and recommendations

Determine if we can assist with your specific case

If we proceed to full service, the $99 is deducted from your total service fee

Niche Expander Product Development - $499 Assessment (60 Minutes)

Meet with our product development experts for a comprehensive 60-minute consultation

Receive a custom product development plan tailored to your business goals

Get scoping for a potential funding deal with us to launch your product

Professional roadmap including sourcing, formulation, compliance, and launch strategy

If we proceed to full service, the $499 is deducted from your total service fee

Important: All assessment fees are non-refundable. These fees cover our expert review time, analysis, and preparation of your assessment report, regardless of the outcome.

2.2 Assessment Outcomes

After the assessment, one of three outcomes will occur:

Case Accepted - We can assist you. We will provide a custom quote for the full service.

For Appeals: You'll receive a quote with the applicable money-back guarantee level (between 50%-100%) based on our professional assessment of case complexity and likelihood of success.

For UK/EU Expansion: You'll receive a detailed proposal covering formation, compliance, fulfillment, and marketplace launch services. You are under no obligation to proceed.

For Niche Expander: You'll receive a comprehensive product development proposal including sourcing, formulation, compliance, and launch strategy. We may also present funding options to help launch your product. You are under no obligation to proceed.

Case Declined - We determine we cannot assist due to case complexity, policy restrictions, or other factors. Assessment fees remain non-refundable as they cover our expert review time.

Further Discussion Required - For complex situations, we may schedule additional consultation time to fully scope your project before providing a final quote.

2.3 Payment Terms for Full Services

All service fees must be paid in full and in advance before work commences

Payment accepted via Stripe and PayPal

All services receive custom pricing based on scope and complexity

Once payment is received and work begins, services are non-refundable except as outlined in our Money-Back Guarantee for Appeals services

Assessment fees ($99 or $499) are credited toward your total service fee if you proceed


3. Money-Back Guarantee (Appeals Services Only)

4. Client Responsibilities

To receive optimal service and maintain eligibility for any guarantees, you agree to:

Notify us immediately if circumstances change

Provide access to necessary documentation

4.2 Following Our Guidance

Do not modify documents or communications we provide

Forward all marketplace communications to us for review before responding

4.3 Communication

Respond to our requests within 48 hours when possible

Check email regularly for updates

Notify us immediately of any marketplace status changes

Critical: Providing inaccurate information or failing to follow our guidance will void any applicable money-back guarantee and may result in case failure.


5. Amazon Data Handling and Compliance

We maintain strict data handling practices aligned with Amazon's requirements:

5.1 Authorization and Data Access

We only act on behalf of sellers who grant us permission through authorized third-party access methods

We never request or accept your Seller Central username, password, or access keys

We only access data necessary to provide our services

We use secure authorization systems for all marketplace data access

5.2 Data Usage Restrictions

We do not use your data for any purpose other than providing our services

We do not market to your Amazon customers

We do not aggregate or sell data across multiple client businesses

We only use Personally Identifiable Information (PII) for merchant fulfilled shipping or legal/tax requirements

We do not share insights about Amazon's business or use such insights for our own purposes

5.3 Compliance Obligations

We comply with Amazon's Acceptable Use Policy and Data Protection Policy requirements

We maintain comprehensive security measures to protect seller and customer data

We notify appropriate parties in the event of security incidents

We maintain transparent data handling practices

5.4 Your Amazon Obligations

You remain responsible for compliance with all Amazon policies, including the Amazon Services Business Solutions Agreement. We provide guidance and support but cannot facilitate violations of your agreement with Amazon.


6. Service Limitations and Disclaimers

6.1 No Control Over Marketplace Decisions

We are not Amazon, TikTok, Walmart, eBay, Etsy, or any other marketplace platform. While we provide expert guidance and compliant documentation, we do not control:

Final approval or rejection decisions by marketplaces

Marketplace policy interpretations or changes

Marketplace review timelines

Account-level restrictions or permanent suspensions

Marketplaces have sole discretion over all account and product decisions.

6.2 Not Legal Advice

We are not lawyers and do not provide legal advice. Our services focus on marketplace compliance, product development, and business operations. For legal matters (such as intellectual property disputes, trademark issues, or regulatory violations), we refer you to qualified legal partners.

6.3 Product Development and Sourcing

For Niche Expander services:

We work with trusted chemists, labs, and factories but do not guarantee product performance or market success

You remain responsible for product safety, regulatory compliance, and liability

Intellectual property in formulations may be retained by the chemist/lab/factory or us by default, but this can be negotiated

We provide marketplace compliance guidance but cannot guarantee approval

6.4 UK/EU Expansion Services

For international expansion:

We handle formation, registration, and compliance setup but do not guarantee marketplace approval or sales performance

You remain responsible for ongoing tax compliance and regulatory obligations

Third-party service providers (3PL, accountants, etc.) operate under their own terms


7. Confidentiality and Data Security

7.1 Your Confidential Information

We understand your business information, product formulations, and seller data are confidential. We commit to:

Maintain strict confidentiality of all proprietary information

Use your information solely for providing our services

Not disclose your information to unauthorized third parties

Sign Non-Disclosure Agreements (NDAs) upon request

Comply with comprehensive security measures (detailed in our Privacy Policy)

7.2 Amazon Data Security

As an Amazon SPN member, we maintain enterprise-grade security controls including:

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from our services is limited to the amount you paid us for the specific service giving rise to the claim.

For example:

If you purchased only a $99 assessment, our maximum liability is $99

If you purchased only a $499 assessment, our maximum liability is $499

If you purchased an appeals service for £1,500, our maximum liability is £1,500

If you purchased a product development service for £8,000, our maximum liability is £8,000

8.2 Excluded Damages

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Lost profits, revenue, or sales

Loss of inventory or business opportunities

Marketplace account suspensions, deactivations, or bans

Damage to business reputation or goodwill

Cost of substitute services

Loss of data or business information

Product liability claims

This limitation applies even if we have been advised of the possibility of such damages.

8.3 Basis of the Bargain

You acknowledge that we have set our prices in reliance upon these liability limitations, which allocate risk between us and form the basis of our agreement.


9. Indemnification

You agree to indemnify, defend, and hold harmless FastTrack, its employees, contractors, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

Your violation of these Terms or any applicable laws

Inaccurate or misleading information you provided

Your failure to follow our guidance or instructions

Your product's non-compliance with safety or regulatory requirements

Product liability claims related to your products

Your violation of marketplace policies or agreements

Third-party claims arising from your use of our services


10. Termination

10.1 By You

You may stop using our services at any time. However:

Assessment fees are always non-refundable ($99 for Appeals/UK-EU Expansion, $499 for Niche Expander)

Once work has commenced on paid services, no refunds are available (except under the Appeals Money-Back Guarantee terms)

Outstanding payment obligations remain due

10.2 By Us

We may terminate or suspend services immediately if you:

Violate these Terms or marketplace policies

Provide false or misleading information

Engage in abusive or threatening behavior toward our team

Fail to pay for services when due

Submit your own appeals or communications without our approval during active engagement

Request services for illegal or prohibited products

Interfere with our ability to provide services

10.3 Effect of Termination

Upon termination:

You lose access to ongoing support

You retain ownership of any delivered documentation or materials

Confidentiality obligations survive termination

Outstanding payment obligations remain due


11. Prohibited Products and Services

We do not provide services for:

Products that are illegal in your jurisdiction or target marketplace

Products prohibited by marketplace policies (e.g., weapons, explosives, illegal drugs, counterfeit goods)

Products designed to circumvent marketplace safety restrictions

Deliberately mislabeled or misrepresented products

Services that would violate Amazon policies or our Amazon SPN agreement

If we discover your product or situation falls into a prohibited category, we reserve the right to decline service or terminate immediately. Assessment fees remain non-refundable as they cover our review time.


12. Intellectual Property

12.1 Your Content

You retain all rights to your product formulations, business information, and proprietary data. You grant us a limited license to use this information solely for providing our services.

12.2 Our Work Product

Upon full payment:

For Appeals: You own the appeal documents and strategies we create for your specific case

For UK/EU Expansion: You own business formation documents and compliance materials

For Niche Expander: Ownership of formulations is negotiated on a case-by-case basis (may be retained by chemist/lab/factory or shared)

You may not resell, redistribute, or license our work to third parties. Our methodologies, templates, processes, and systems remain our property.


13. No Warranties

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:

Implied warranties of merchantability

Fitness for a particular purpose

Uninterrupted or error-free service

Guaranteed results or outcomes

The only warranty we provide is the Money-Back Guarantee for Appeals services as detailed on our Money-Back Guarantee page.


14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, please contact us at [email protected] to resolve issues informally. We commit to working with you in good faith for at least 30 days.

14.2 Governing Law

These Terms are governed by the laws of Northern Ireland and the United Kingdom, without regard to conflict of law principles.

14.3 Jurisdiction

Any legal disputes not resolved informally shall be brought exclusively in the courts of Northern Ireland, and you consent to the jurisdiction of such courts.


15. General Provisions

These Terms, together with our Privacy Policy and Money-Back Guarantee page, constitute the entire agreement between you and FastTrack.

15.2 Modifications

We may update these Terms at any time. Material changes will be notified via email and/or website notice. Continued use after changes indicates acceptance.

15.3 Severability

If any provision is found unenforceable, it will be limited to the minimum extent necessary, and remaining provisions remain in effect.

15.4 No Waiver

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, internet failures, or marketplace platform changes.
